General Terms and Conditions of Sale

Pursuant to Chapter I, Title III, Part III of Legislative Decree No. 206/2005 (Italian Consumer Code) and subsequent amendments

Introduction and Scope

These General Terms and Conditions of Sale (the “Terms and Conditions”) govern the purchase of products and services carried out remotely via the Internet on the website
torrefazioneelmiguel.it (the “Website”), in accordance with Italian law and EU consumer protection regulations.

Placing an order implies full acceptance of these Terms and Conditions. Contracts concluded through the Website are governed by Italian law and drafted in Italian.
If the Customer requests an invoice and/or acts as a business, the withdrawal rights under the Consumer Code do not apply.

1. Product Selection and Orders

Product features and prices are listed in their respective product sheets. To make a purchase, the Customer must add the desired Products to the cart, complete the online form,
accept these Terms and the Privacy Policy, enter shipping and billing details, choose a payment method, and confirm the order.

The contract is finalised when the Customer receives an Order Confirmation Email from Torrefazione El Miguel, containing order number, delivery details, product list and total price.
Any errors must be reported within 12 hours by emailing info@elmiguel.it.

2. Product Information

Images are for illustrative purposes only and may differ in colour or size. In case of discrepancies, the written description on the product page prevails.

3. Prices and Shipping

All prices are expressed in Euros (€), VAT included. Shipping costs are displayed before payment confirmation.

• Italy: €8.00 – free shipping for orders over €70.00
• Europe: €11.00 – free shipping for orders over €80.00
• Non-EU countries: €50.00 – free shipping for orders over €80.00

4. Payment Methods and Invoicing

4.1 Payment Methods

• Credit/Debit Card (Visa, Mastercard, Maestro, American Express)
• PayPal

Payments are processed securely (SSL). The Website does not store credit card data.

4.2 Invoicing

Invoices must be requested at the time of order by entering the correct billing information. Invoices are sent via email. It is not possible to request an invoice after order completion.

5. Delivery

Products are shipped via express courier to the address provided by the Customer, Monday to Friday (excluding holidays). Average delivery time within Italy: 2–5 business days.
Torrefazione El Miguel shall not be held responsible for delays caused by the courier or force majeure. A shipping confirmation email with tracking details will be sent once the order is dispatched.

6. Right of Withdrawal

The Customer has the right to withdraw from the purchase within 14 days of receiving the Products, without penalties and without justification, by notifying:

Refunds will be issued within 14 days of withdrawal notice or product receipt (whichever occurs first) using the same payment method. Return shipping costs are borne by the Customer.

Exclusions: opened or partially consumed food products; customised goods; perishable items.

7. Legal Warranty and Product Defects

Under Articles 128 et seq. of the Italian Consumer Code, all Products are covered by a 24-month legal warranty of conformity. Defects must be reported within 2 months of discovery by emailing
info@elmiguel.it. The Customer is entitled to repair, replacement, price reduction or contract termination, depending on the case.

8. Errors and Limitation of Liability

Product information is regularly updated but may contain errors. Torrefazione El Miguel reserves the right to correct any inaccuracies even after order submission, without prejudice to the Customer’s rights.
Except in cases of wilful misconduct or gross negligence, the Company shall not be liable for any direct or indirect damages arising from order acceptance or fulfilment.

9. Complaints

Any complaints regarding purchases or order management must be submitted to Torrefazione El Miguel S.r.l. using one of the following methods:

Torrefazione El Miguel S.r.l. undertakes to respond to all complaints within 7 business days.

10. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For consumer disputes, jurisdiction lies with the Customer’s place of residence or domicile. For business clients (B2B), the exclusive jurisdiction is the Court of Varese (Italy).

11. Specific Clauses

In accordance with Article 1341 of the Italian Civil Code, the Customer specifically approves the following clauses: 5 (Delivery – delays), 8 (Limitation of liability), 10 (Jurisdiction).
